1. Acceptance of Terms

Welcome to SK Builds (https://sunilkhobragade.pages.dev), operated by Sunil Khobragade ("we", "us", "our", or "the Engineer"). By accessing, browsing, booking consultations through, or utilizing any utilities on this website, you agree to be legally bound by these Terms of Service.

If you are engaging our engineering or consulting services on behalf of an organization or business entity, you represent and warrant that you possess full authority to bind that entity to these Terms. If you do not agree to these terms, please discontinue using this website and our services.

2. 1:1 Architecture Consultations & Discovery Calls

We provide real-time appointment booking at /tools/appointment for 1:1 technical discovery and software architecture review sessions.

• Scope of Discovery Sessions: Calls are intended for evaluating technical feasibility, reviewing system architecture, discussing tech stacks (Node.js, Python, PostgreSQL, Redis, AI Agents), evaluating project scope, and exploring prospective freelance or contract engagements.
• Punctuality & Rescheduling: Reschedule or cancellation links are automatically provided in your meeting confirmation. We request at least 4 hours advance notice if you need to reschedule a confirmed consultation.
• Professional Advisory Only: Technical feedback provided during discovery calls represents professional software engineering guidance based on the information disclosed. It does not constitute formal legal, financial, compliance, or regulatory certification.

3. Freelance Engineering Engagements & Estimates

Any formal software development engagement, custom SaaS build, or architecture consulting project is governed by mutually agreed contractual milestones:

• Estimator Approximations: Figures, timelines, and budgets generated using our interactive Project Estimator Tool represent preliminary ballpark calculations and do not constitute a binding quote until formal discovery is completed and a Statement of Work (SOW) is executed.
• Statements of Work (SOW): Paid engagements commence upon execution of a specific SOW detailing agreed deliverables, milestones, tech stack, timeline, and pricing structure.
• Milestone Invoicing: Projects typically operate on defined milestone phases (e.g., 30% project kickoff and architecture design, 40% functional staging build, 30% production deployment and asset transfer).
• Change Orders: Substantial alterations to the agreed project scope during active sprints will be scoped into an explicit Change Order with adjusted timelines and fee schedules before implementation.

5. Confidentiality & Non-Disclosure (NDA)

We strictly respect commercial confidentiality. We regularly sign bilateral Non-Disclosure Agreements (NDAs) prior to receiving proprietary source code, wireframes, business metrics, or database credentials.

All confidential materials, API credentials, business models, and trade secrets disclosed by clients during discovery or development will be held in strict confidence, accessed solely on secured workstations, and never disclosed to outside parties.

6. In-Browser Tools & AI Copilot Disclaimer

• Client-Side Utilities: The 20+ developer utilities provided on /tools (e.g. JSON to TS, SQL Formatter, Regex Tester, JWT Decoder, Cron Generator) are provided free of charge on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• AI Assistant (SK Agent): Responses provided by our AI copilot are generated dynamically via large language models. While fine-tuned to represent verified technical engineering patterns, users should perform their own technical verification before deploying generated code to production systems.

7. 30-Day Bug-Fix Warranty & Liability Limitations

We stand firmly behind the quality, reliability, and security of our engineering work:

• 30-Day Post-Launch Warranty: All custom milestone deliveries include thirty (30) days of complimentary bug-fix support following production deployment to remediate any software defects within agreed scope.
• Limitation of Liability: In no event shall Sunil Khobragade or SK Builds be liable for indirect, incidental, special, or consequential damages (including loss of profits, data corruption, or business interruption) arising out of the use of our website or free developer tools.
• Liability Cap: For paid contract engagements, the total aggregate liability under any circumstances is strictly capped at the total amount paid by the client under the specific Statement of Work giving rise to the claim.

8. Governing Law & Dispute Resolution

These Terms and any non-contractual obligations arising out of them shall be governed by and construed in accordance with the laws of India, with jurisdiction in Hyderabad, Telangana, without prejudice to standard international commercial arbitration principles mutually agreed in formal contract Statements of Work.
